Terms and Conditions of Entry for the 'Homes of Coffee' Promotion
1. These terms and condition of entry, including information on how to participate and prize details (Terms), apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.
2. The Promoter is Cerebos Gregg's Limited, 51 Forth Street, Dunedin 9016, New Zealand.
3. The Robert Harris Cafe outlets participating in the Promotion (Participating Outlets) are listed at www.robertharris.co.nz/cafe-locator/
4. The Promotion will be open from 12:01am NZST on 4th September 2017 until:
a) 11:59pm NZST on 29 October 2017; or b) At the time and date all Scratch Cards (as defined in paragraph 7 of these Terms) have been distributed by the Participating Outlets, whichever occurs first (Promotion Period).
5. Entry in the Promotion is only open to New Zealand residents residing in New Zealand, aged 18 and over excluding:
a) management, employees, directors and contractors of the Promoter, its related entities of Cerebos Gregg's Limited, the Participating Outlets and other agencies, firms or companies associated with the Promotion (including suppliers of prizes); b) a relative* of a person referred to in paragraph 5(a) of these Terms; including, but not limited to, a spouse, de-facto spouse, parent, guardian, child or sibling c) persons who have used or attempted to use any more than one name in order to qualify to win a promotion previously run by or on behalf of the Promoter (except in the case of a legal change of name); and d) persons who have breached the terms and conditions of any promotion previously run by or on behalf of the Promoter, *(Eligible Entrants). The persons referred to in paragraph 5(b) of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion
6. To be eligible to win, Eligible Entrants must, during the Promotion Period, purchase a minimum of $15 including GST worth of food and/or beverage in a single transaction (Qualifying Purchase) from a Participating Outlet:
a) Eligible item's are anything that sits under the following categories:
- Robert Harris café menu
- Cabinet food
- Hot and chilled beverages
7. Each Eligible Entrant will receive a single Promotion Scratch Card (Scratch Card) for each Qualifying Purchase. For example, if an Eligible Entrant purchases over $15 including GST and under $30 including GST, the purchaser is only entitled to one Scratch Card. Purchases in amounts of $15 including GST entitles purchaser to one scratch card for every $15 including GST spent.
8. The Eligible Entrant must complete their entry in accordance with these Terms (Eligible Entry)
9. Entry is via SMS 5574 (Max. SMS cost 20c including GST).
10. An Eligible Entrant will be granted one (1) entry into the prize draw for each Eligible Entry submitted via SMS.
11. Eligible Entrants can complete their Eligible Entry during the Promotion Period by sending an SMS to 5574. (Max. SMS cost 20c including GST), containing: a) The unique code (Unique Code) shown on the Scratch Card; b) Their first name; and their last name and which complies with paragraph 12 of these Terms (SMS Entry).
12. For an SMS Entry to be valid: a) it must be sent from an SMS enabled mobile handset (SMS entries sent via the internet are ineligible) that is connected to a service provider and service plan (if applicable) that permits the Eligible Entrant to send SMS to premium SMS numbers (some handsets are incompatible and some service providers and / or some service plans do not permit premium SMS); b) it must be identifiable by a MSISDN (unique mobile SIM number); c) the Eligible Entrant submitting the SMS Entry must have the bill payer's permission to enter the Promotion prior to submitting their SMS Entry; and d) it must be in the following format (Required Format):
Unique Code + First Name + Last Name

13. Maximum cost of each SMS Entry is 20 cents (including GST).
14. SMS Entry service provided by MKTG, phone: 0508 276 556.
15. If an Eligible Entrant submits a valid SMS Entry which complies with the Required Format and contains a valid Unique Code they will receive an SMS response confirming that their SMS Entry is valid and has been received (SMS Response).
16. If an Eligible Entrant submits an SMS Entry which does not comply with the Required Format and / or does not contain a valid Unique Code and / or otherwise does not comply with these Terms, they will receive an SMS response informing them of the error in their SMS Entry (Error SMS Response).
17. SMS Response and / or Error SMS Response (as applicable) receipt times may vary and are subject to network coverage and availability, the number of entries received by the Promoter, the available memory on the entrant's mobile SIM card and other technical factors.
18. If the Eligible Entrant receives an Error SMS and chooses to submit a new SMS Entry in the Required Format and containing a valid Unique Code, and otherwise complies with these Terms, they will be charged an additional 20 cents (including GST).
19. Eligible Entrants should scratch the bottom panel (Scratch Panel) from their Scratch Card to see if they are an instant winner.
20. Instant prizes will include: a. 2,150 x small sized Robert Harris coffees (RRP $4.00) b. 430 x 350ml sized coffee keep cups (RRP $14.95) c. 344 x Robert Harris Freeze Dried Coffee 100g Retail Packs (RRP $8.95) d. 86 x $10 Robert Harris Café gift cards (RRP $10.00) The Robert Harris Café gift cards are bound by the following terms: i. The Robert Harris gift card can be used for purchases at any Robert Harris Cafe in New Zealand. To check the card balance by SMS (costs $0.50) - text 'BALANCE' followed by your card number and pin to '8810', or check your card balance or expiry date by visiting www.robertharris.co.nz. Any balance on the card can be used in whole or part purchase against your next purchase at a Robert Harris Cafe. No change is given. This card cannot be topped up, is not returnable or redeemable/exchangeable for cash and cannot be used towards the purchase of another gift card. Please treat this card as cash. It cannot be replaced, and Robert Harris shall not be responsible for any gift card that may be lost, stolen or damaged. The card expires 12 months from the date of activation. Any unused balance remaining on the gift card after expiry is forfeited. Purchase, use or acceptance of the gift card constitutes acceptance of these terms.
(Instant Win Prizes)
21. There are 3,010 Instant Win Prizes to be won in total.
22. Instant Win Prize winners will be required to present their winning Scratch Card to the cashier that issued the Scratch Card to claim their Instant Win Prize.
23. All Instant Win Prizes must be redeemed in the Participating Outlet prior to end of trading hours on 29 October 2017 or their prize will be forfeited.
24. Instant Win Prize winners will be eligible for the Major Prize Draw.
25. The total maximum Instant Prize Pool is NZ$18,967.30 (recommended retail value including GST).
26. An electronic random prize draw will be conducted at MKTG, 68 Sale Street, Victoria Quarter, Auckland (Draw Location) at 12:00pm NZST on 31 October 2017 from all Eligible Entries received during the Promotion (Major Prize Draw).
27. The first Eligible Entrant with a valid Eligible Entry drawn in the Major Prize Draw will win a trip, valued at up to NZ$11,200 (recommended retail value - including GST) (Prize).
28. The Prize comprises of:
• Return economy class airfares for two (2) from the Winners nearest commercial New Zealand airport to one (1) travel destination
• All airline and airport taxes
• Return private transfers from airport to accommodation
• Daily breakfast
• NZ$500 including GST spending money
29. The Major Prize Winner and their guest may extend their trip at their own expense. They will be required to liaise with MKTG when booking their travels. The Promoter is in no way responsible for any additional costs incurred including flight changes.
30. The Major Prize Winner will be notified by mobile and/or email within two (2) business days of the draw.
31. The first initial and surname of the Major Prize Winner will be published on www.robertharris.co.nz/promotions/ and the Robert Harris Facebook page on 2 November 2017.
32. Major Prize Winner Destination options include (Major Prize Winner to choose one (1) option only): a) Bali, Indonesia: return economy class airfares for two (2) from winners nearest commercial New Zealand airport to Denpasar, Indonesia, five (5) nights, four (4) star, twin share, private villa accommodation in Seminyak. A Lembongan Island catamaran cruise with beach club activities and a buffet lunch for two (2). b) Hanoi, Vietnam: return economy class airfares for two (2) from winners nearest commercial New Zealand airport to Hanoi, Vietnam, five (5) nights, four (4) star, twin share accommodation in Hanoi, a Hanoi night market and street food tour for two (2), a private cooking experience in a local Hanoi home for two (2). c) Waikiki, Hawaii: return economy class airfares for two (2) from winners nearest New Zealand commercial airport to Honolulu, five (5) nights, four (4) star, twin share Waikiki accommodation, a private 1.5 hour surfing lesson for two (2) with pro-level instruction.
33. All costs associated or arising in connection with the Major Prize are the responsibility of the Major Prize Winner
34. The Major Prize is subject to any terms and conditions imposed by the prize supplier/s. The Major Prize Winner and their guest must be able to make their own way to and from the departing airport and/or location specified (if required). Flights include all airfare taxes. Flights, activities and accommodation are subject to booking and availability.
35. The Major Prize must be taken on dates specified by the Promoter. The Major Prize cannot be taken during major event/peak/public holiday periods or any other periods as specified by the prize supplier/s.
36. The Major Prize Winner and guest must be in possession of a valid passport with a minimum of 6 months validity on it prior to departure for all international travel.
37. Prize must be taken within 12 months of receiving the prize and booked a minimum of 60 days prior to departure.
38. The Major Prize Winner must ensure that they (and their guest) have obtained any necessary medical clearances required and are sufficiently healthy and fit to safely take the trip and undertake the relevant activity/ies awarded as part of the Major Prize.
39. Valid identification, additional spending money, passport, meals (other than those included) and any other ancillary costs, including but not limited to insurance and any applicable insurance excesses, not listed in the Prize descriptions above are the responsibility of the Major Prize Winner and his/her nominated travelling guest as incurred. It is the Winner's responsibility to organise transport to/from the airport departure/return point in New Zealand.
40. The Major Prize Winner must hold a valid credit card and present it at the Accommodation to cover any incidental charges they include during their stay.
41. Terms are subject to change at the Promoter's absolute discretion, including, but not limited to, due to a change in a location's security classification, natural disaster or other acts of God. The Promoter may make these changes at any time prior to the Major Prize Winner and their nominated travel guest departing on their trip, subject to any laws of New Zealand.
42. Penalties may apply for re-booking, amending, extending or cancelling travel and/or Accommodation, and the responsibility or winners and/or their nominated travel guest as the case may be.
43. All components of the Prize must be taken together in a single trip and cannot be redeemed separately.
44. Any components of the Prize not used by the winner or their nominated travel guest is forfeited and the Promoter is not obliged to provide the winner or their nominated travel guest with the cash equivalent of or any substitute for any Prize component in those circumstances
45. It is the responsibility of the Major Prize Winner and their nominated travel guest to ensure they have obtained all relevant visas and vaccinations, and comply with all other requirements, for travel to their chosen destination. The Promoter takes no responsibility for forfeiture of travel as a result of a failure to meet such requirements.
46. Acceptance and use of the Prize by the Major Prize Winner and their nominated travel guest is subject to the winner and their nominated travel guest: 1. obtaining travel insurance for the duration of their participation in the Prize of an amount, and from an insurer, acceptable to the Promoter; and 2. agreeing not to act or fail to act in a manner which brings or may in the Promoter's opinion bring the Promoter or its related entities into disrepute, during the course of their participation in the Prize.
47. Terms are subject to change at the Promoter's absolute discretion, including, but not limited to, natural disaster or other acts of God. The Promoter may make these changes at any time prior to the Prize winner taking the Prize, subject to written directions from the New Zealand Courts.
If the Prize is won and the Eligible Entrant does not claim their prize by 11:00am NZST on 14 November 2017, a random re-draw will be conducted on that date at 12:00pm NZST at the Draw Location by one of its representatives from all remaining Eligible Entries received in the Promotion. (Re-Draw).
The Re-Draw Prize winner, if any, will be: a) notified by mobile and email; and b) published on www.robertharris.co.nz/promotions/
48. The total Major Prize Pool value is up to NZ$11,200 (recommended retail value - including GST).
49. The total Prize Pool value is up to NZ$30,167.30 (recommended retail value - including GST).
50. Eligible Entrants must retain, and submit to the Promoter, the original Scratch Card (Proof of Purchase) which corresponds to all entries they submit in the Promotion in order to claim the Prize.
51. If requested by the Promoter, the provisional Prize winner must produce, within the time requested by the Promoter at its absolute discretion: a) appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim the Prize and compliance with these Terms.
Before the Promoter issues their Prize. If the items required by the Promoter are not received or a provisional winning entry has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the provisional winner's entry will be invalid and, at the Promoter's absolute discretion, all of the provisional winner's remaining entries will be invalid. Prizes will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction.
52. If more than one person attempts to claim a Prize, the Promoter has sole and absolute discretion to determine which of those persons is the winning Eligible Entrant.
53. Printing and other quality control errors will not invalidate an otherwise valid Instant Win Prize claim. Unless otherwise due to fraud or ineligibility under these Terms, all Instant Win Prize claims in excess of the advertised prize pool will be honoured. Scratch Cards are void if stolen, forged, mutilated or tampered with in any way. There will be a total of 500,000 Scratch Cards printed for this promotion.
54. Each Qualifying Purchase counts towards one entry only.
55. Each Eligible Entry must be a) based on a separate Qualifying Purchase; and b) submitted separately in accordance with these Terms.
56. Multiple entries are permitted, however each entry must be based on a separate Eligible Purchase and separate Unique Code and must be submitted separately in line with the Entry Process.
57. As proof of purchase, entrants must retain their original itemised receipt and Scratch Card (from their Eligible Purchase). EFTPOS receipts will NOT be accepted. The Promoter may, at any time during or after the Promotion, request an entrant to provide sufficient proof of purchase to validate any or all of the entrants' entries. Proof of purchase must show that the Eligible Purchase was made during the Promotion but prior to entry. Sharing receipts/Unique Codes is strictly NOT permitted. If an entrant fails to provide unaltered proof of purchase that is to the Promoter's satisfaction and in the timeframe specified by the Promoter, the Promoter may (in its absolute discretion) invalidate any or all of the entrants' entries and that entrant will have no entitlement to receive any prize in this competition.
58. There is a limit to the number of Unique Codes which are invalid that may be submitted by entrants in attempting to enter the Promotion. The Promoter may, at its absolute discretion, block and / or disqualify Entrants from submitting further entries into the Promotion where they have reached that limit. Entrants will be sent an SMS message confirming that they have been blocked and / or disqualified from submitting further entries into the Promotion if they are blocked and / or disqualified.
59. In order to claim and/or participate in the Prize, the Major Prize Winner is required to sign a Promotion Participation Agreement on terms determined by the Promoter, including: a) confirming their eligibility to enter the Promotion and compliance with these Terms; and b) providing a release and indemnity in favour of the Promoter in respect of their participation in the Promotion and acceptance and use of their Prize.
60. Prizes are not transferable, exchangeable or redeemable for cash.
61. The Promoter accepts no responsibility for any variation in the value of the Prizes.
62. If the Promoter is unable to provide the winner with the nominated Prize, the Promoter reserves the right to supply an alternative prize of similar monetary value to the nominated prize, subject to any laws of New Zealand and shall be subject to the exclusive jurisdiction of New Zealand Courts.
63. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries. The Promoter does not warrant that the entry mechanism will be available, or the Participating Outlets will be open, at all times during the Promotion Period.
64. If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to any laws of New Zealand including cancelling, terminating, modifying or suspending the Promotion
65. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism or Draw in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.
66. Incomplete, illegible, indecipherable or incorrect entries are not eligible to win.
67. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms. The Promoter's decisions in relation to all aspects of the Promotion are final and binding on each entrant and no correspondence will be entered into.
68. The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award the Prize. If the personal information requested is not provided, the entrant cannot participate in the Promotion. By participating in the Promotion, each Eligible Entrant consents to the Promoter using, and disclosing their personal information to the Promoter's related entities, the Promoter's agencies and other third parties engaged to provide services in connection with the Promotion including suppliers of Prize, for the following purposes: a) contacting the entrant in relation to the Promotion; b) improving the Promoter's or the Promoter's related entities' goods and services; and c) the purposes set out in the Promoter's privacy policy at www.cerebos.co.nz/Privacy.aspx d) The Eligible Entrant provides this consent until such a time as they withdraw their consent by giving notice to the Promoter. Eligible Entrants can also gain access to, update or correct any personal information held by the Promoter where all personal information will be stored.
69. By entering this competition and providing your email address, you are agreeing to be contacted by Cerebos Gregg's Limited for promotional purposes in relation to our Robert Harris cafes and brand.
70. The: a) Promoter, the Promoter's related entities, the Participating Outlets, and all agencies associated with the Promotion; and b) the employees, agents, directors and contractors and anyone working on the promoter's behalf, shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of, or participation in, the Prizes, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
71. The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of the Prize.
72. Eligible Entrants agree and acknowledge that all entries and any intellectual property rights subsisting in their entries become and remain the property of the Promoter.
